Acceptance of Terms Danielson Designs offers its website and custom services to you subject to the following User Agreement. This User Agreement may be updated occasionally without notice to you, and your continued use of the Danielson Designs website after such changes establishes your acceptance of the new terms. In short, by continuing to use the Danielson Designs website, you are signifying to be bound by the terms of this User Agreement and all changes made thereafter.

User Account, Password, and Security

Registering with Danielson Designs yields an account for which you have a password. You are solely responsible for keeping confidentiality of your password and account, and are fully responsible for all actions that take place under your password and account. You agree to sign-out of your account after each session on Danielson Designs, and agree to notify Danielson Designs immediately of any unauthorized use of your password or account, or any other break of security. Danielson Designs will not be held liable for any loss or damage occurring due to your failure to follow these agreements. As well, the use of any means to interfere with the normal functionality of this website is prohibited. This includes denial of use attacks, reverse engineering, etc. This website also may not be used to harass others. This includes but is not limited to using the e-mail functionality for the purpose of knowingly sending material to anyone who does not wish to receive that material. Neither shall “bots” or any automated mechanism be used to automate any of the functionality on the site.

User Conduct, Warranty of Ownership, Non-Infringement, and Termination

In using the Danielson Designs website, you agree not to submit any text or images for your designs that are unlawful, threatening, abusive, defamatory, obscene or which in any way invade another person’s privacy. You also agree not to submit any text or images that are not lawfully yours to submit, such as (but not limited to) text which may infringe upon another’s copyright. By submitting text or images you affirm that you warrant the lawful right to reproduce said text and images and that the text and images obey all applicable federal, state and local laws, regulations and ordinances. Please note that Danielson Designs does not monitor the submitted text or images of designs, although Danielson Designs reserves the right to do so (but not the obligation to do so). Danielson Designs designates the right to cancel any orders of submitted text or images that infringe on copyright, or include profane, violent, offensive, or otherwise deemed by Danielson Designs to be inappropriate or distasteful text or images. Danielson Designs will terminate the accounts of repeat copyright infringers. You acknowledge and allow that Danielson Designs may keep and disclose your design with submitted text or images if required to do so by law or in the good faith belief that such preservation or disclosure is rationally necessary to obey legal processes, enforce the agreement, or respond to claims that text violates the rights of third parties.

Indemnity

You agree to defend, indemnify and hold Danielson Designs, its subsidiaries and affiliates, and each of their officers, directors, agents and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including but not limited to reasonable attorney’s fees, expert witness fees, and costs of litigation arising out of or in connection with the text you upload to the Danielson Designs website, your use of and connection to the Danielson Designs website, any breach of this User Agreement, or any violation of the rights of a third party.

Customized Product

You acknowledge that individual monitors vary in their color representation, and understand that actual color on your product may be different than the color shown on the website. You also acknowledge that you are solely responsible for the spell checking and final proofing of your customized product. Your design will be printed as submitted. In addition, you understand that this website may not be used to create designs for products other than our own, whether or not you purchase the designed product. Using the created design to mass-produce in any medium, whether electronic or tangible, is prohibited. You also acknowledge that Danielson Designs is given the right to publish any comments or designs you submit to this website.

Notice and Take Down Procedures for Copyright Infringement

Danielson Designs is dedicated to the appropriate use of third party intellectual property. Danielson Designs prohibits you and all other users to include text in your design that you do not have the rights to. Should you believe that one of our customers has infringed on your intellectual property, please write a letter or send an e-mail to the addresses below with the following information: · A statement from the copyright holder or authorized representative of what text is believed to have been infringed. · Sufficient information about the location of the supposedly infringed text so that Danielson Designs can locate and confirm its existence. · Your name, telephone number and e-mail address. · A statement from you under penalty of perjury that the information supplied is accurate, and that you are authorized to act on the copyright owner’s behalf. · A signature or the electronic equivalent from the copyright holder or authorized representative. After researching and taking the suitable actions to remove any infringed intellectual property, we will contact you within a week of any and all actions taken by Danielson Designs concerning the issue.
